Preliminary Information Form

This Preliminary Information Form (“Preliminary Information Form”) has been prepared in order to inform the consumer who purchases the products that have the characteristics and sales price specified below and that are offered for sale on the website certificate.enerjisacommodities.com about the sale and delivery of these products in accordance with the requirements of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

1.  Definitions:

    Seller: Refers to the legal entity whose information is provided in Article 2 of this Preliminary Information Form.

    Buyer: Refers to the real or legal person who purchases the products/services of the Seller, the information of whom is provided in Article 3 below.

    Platform: Refers to the website certificate.enerjisacommodities.com belonging to the Seller.

    Distance Sales Contract: Refers to the Distance Sales Contract concluded between the Seller and the Buyer.

    Products: Refers to Carbon Reduction Credits and Renewable Energy Certificates, which are offered for sale through the Platform and whose definitions are given below. The main characteristics of the Products are included on the Platform, in the Distance Sales Contract, and in this Preliminary Information Form.

4.  Carbon Credit / Renewable Energy Certificate Sales Information:

    a. Products:

• Carbon Credit: Carbon Credit (Credit) belonging to a real or legal person, standardized, tradable and expressed in metric tons of carbon dioxide (tons-CO2).
• Renewable Energy Certificate: A market-based instrument representing the ownership rights of the environmental, social, and other non-power qualities of renewable electricity generation and/or a renewable energy certificate approved by national and/or international organizations, indicating that 1 (one) MegaWatt-hour (MWh) of electricity has been produced from a renewable energy source and delivered to the electricity grid.

    b. Total Price of the Products:

  The prices listed and announced on the Platform are the sales prices including all taxes and are valid until any update or change is made by the SELLER.

    c. Payment, Invoicing, and Delivery:

• Payment Methods: If the Buyer approves the Distance Sales Contract, the price of the Products they have been ordered will be collected from the Buyer using the payment method they have chosen. The Buyer can pay the prices of the Products within the scope of the order by choosing one of the following methods:

        a)  Payment by credit or debit card,

        b)  Payment with iyzico.

        The Buyer must have paid the price in full before receiving the Products. If, for any reason, the price of the Products is not paid by the Buyer or the payment made is canceled in the bank records, the Seller will not have an obligation to deliver the Products.

• Delivery and Delivery Time: The relevant product will be sent to the BUYER's e-mail address mentioned above within a maximum of 5 (five) business days after the price of the product has been credited to the SELLER's account.
• Invoice Delivery: The relevant invoice subject to trade will be sent to the same e-mail address within 7 (seven) calendar days from the day the Products are delivered to the Buyer's e-mail address above.

    d. Right of Withdrawal, Products for Which the Right of Withdrawal Cannot Be Used, Returns, and Cancellations:

• The Products are prepared according to the Buyer's request and approval and subject to an exception provided for the right of withdrawal arising under Article 15.1 (b) of the Distance Contracts Regulation, and the Products are specifically arranged for the Buyer after the Buyer approves the relevant Distance Sales Contract, makes the necessary payment, and the payment is credited to the Seller's account and therefore, the Products cannot be returned or cancelled under any circumstances. In this context, the right of withdrawal cannot be exercised for the Products. The Buyer has accepted that they cannot exercise the right of withdrawal for the Products in accordance with Article 15.1 (b) of the Distance Contracts Regulation.

5.  Confirmation and Validity:

    The Buyer declares that they have read and have been correctly and completely informed about the basic characteristics of the Products subject to sale, the sales price and the payment method, and the preliminary information regarding delivery in this Preliminary Information Form, which constitutes an integral part of the Distance Sales Contract, and that they have given the necessary confirmation. The Preliminary Information Form becomes valid and comes into effect when read and accepted by the Buyer electronically. After this Preliminary Information Form is read and accepted by the Buyer electronically, the process of establishing the Distance Sales Contract will begin.

    After the Distance Sales Contract is approved by the Buyer and the order of the Products is completed, the Preliminary Information Form and the Distance Sales Contract will also be sent to the Buyer's e-mail address mentioned above.

6.  Resolution of Disputes:

    In the event of disputes arising between the Buyer and the Seller regarding the Products and purchase transactions, the Consumer Arbitration Committees located at the Seller's official residence shall be authorized up to the value determined by the Ministry of Industry and Trade, and the Istanbul Arbitration Center shall be authorized for values above. Such dispute shall be finally resolved through arbitration in accordance with the Istanbul Arbitration Center Arbitration Rules. The Rules Regarding the Emergency Arbitrator shall not apply. The place of arbitration shall be Istanbul, Turkey.
